FIVE new vaping laws are set to be rolled out across the UK from October 29. The government has confirmed the new laws in an aim to crackdown on who can buy the devices and how the products are marketed. This is when someone over the age of 18 attempts to buy banned products on behalf of someone who is under the age of 18. A series of rules are also coming into place regarding the promotion of vaping and nicotine products. From October 29, it will be an offence to give away vaping or nicotine products free of charge “where the purpose or effect is to promote the product”. This also includes selling the products at a “substantial discount”, giving a coupon or selling a coupon at a “substantial discount” for any vaping or nicotine products. Full list of new vaping laws confirmed for October 29: According to the government website, from October 29, it will be considered an offence to: Sell any vaping and nicotine products to a person under the age of 18 For anyone aged over 18 to buy, or attempt to buy, vaping or nicotine products on behalf of a person under the age of 18 Give away a vaping or nicotine product for free where the purpose or effect is to promote the product Sell a vaping or nicotine product at a substantial discount where the purpose or effect is to promote the product Give a coupon or sell a coupon at a substantial discount for vaping or nicotine product where the purpose or effect is to promote the product. The series of new rules will apply to all vaping and nicotine products, including vape pens, e-liquids, coils, vape pods and nicotine pouches, strips and pearls. Most read in Health Restrictions will not apply to devices or products used for medical purposes. The new rules will replace the previous restrictions in England, Wales and Northern Ireland that currently only apply to nicotine vaping products. Age restrictions were already imposed on the sale of nicotine and non-nicotine vapes in Scotland, but under the changes, they will now apply to nicotine products as well. Anyone caught selling vaping or nicotine products to someone under the age of 18, or proxy-purchasing, in England, Wales or Scotland, could be slapped with a fixed penalty notice of £200 with Northern Ireland residents set to receive higher fines of £250. Large fines or even a summary conviction could be issued to someone caught committing this offence. These fines can hike up to £2,500 in England, Wales and Scotland and £5,000 in Northern Ireland. Those caught freely distributing a vaping or nicotine product or selling a product at a substantial discount may receive a fine, summary conviction or conviction on indictment. Anyone who suspects someone of selling vaping or nicotine products to those who are underage can report them to local trading standards in England, Wales and Scotland or the local council in Northern Ireland. The upcoming restrictions follow the government’s recent clampdown on vape stores and rogue operators. Planning permission is now required for outlets to sell e-cigarettes and the definition of vape shops is set to be tightened to stop any businesses claiming to be a convenience store. Comment now
