Roblox can’t arbitrate father’s lawsuit

SAN FRANCISCO — The Ninth Circuit ruled that federal court in California properly denied Roblox’s motion to compel arbitration in which a father, suing on behalf of a class of parents, challenged the company’s terms of service for its popular computer game. He says he was misled by the gaming platform into believing it was safe for his children, but that another user tried to groom his daughter and convince her she had an alternative sexual orientation. “A party cannot ask the district court to dismiss a complaint on the merits, holding in reserve a claimed right to arbitrate that will be exercised only if it does not like the district court’s decision.”Read the ruling here.Read our prior coverage of this dispute between Roblox and the father here.Subscribe to our free newslettersOur weekly newsletter Closing Arguments offers the latest about ongoing trials, major litigation and rulings in courthouses around the U.S. and the world, while the monthly Under the Lights dishes the legal dirt from Hollywood, sports, Big Tech and the arts.Additional Reads
