(ABC News: Rosanne Maloney)He is the last of three surviving occupants in the car to be charged.Police allege that on June 21, Mr Burns broke into a property on Pomona Avenue and stole a Toyota Fortuna before driving the vehicle to the Cairns suburb of Stratford.Police were called to the scene after 4am, following reports the car had rolled off an embankment.A 12-year-old boy died at the scene after being thrown from the car during the crash.Mr Burns and two other passengers, a 19-year-old Yarrabah woman and 20-year-old Oscar Samual Lee Savage, were taken to Cairns Hospital.Flowers remain at the site where the 12-year-old boy died. (ABC News: Conor Byrne)Mr Burns's matters are before the courts.Mr Savage and the 19-year-old woman have been charged with offences relating to the theft of the vehicle and other driving-related matters.Mr Savage is due to return to court next month.The woman is due to appear in court on Wednesday.
