DENVER — The 10th Circuit revived three environmental organizations’ lawsuit attempting to get Suncor Energy to comply with a 20-year-old consent decree regarding air pollution emitted by refinery plants in Colorado. The consent decrees were originally between the Environmental Protection Agency, Valero and Conoco Phillips, but those refineries are now owned and operated by Suncor Energy, which the activists accuse of failing to abide by the mandates of the Clean Air Act. “The lower court applied the diligent prosecution bar to standards and limitations not found in the consent decrees.”Read the ruling here.Read our coverage about similar lawsuits concerning Suncor Energy and Colorado here and here.Subscribe to our free newslettersOur weekly newsletter Closing Arguments offers the latest about ongoing trials, major litigation and rulings in courthouses around the U.S. and the world, while the monthly Under the Lights dishes the legal dirt from Hollywood, sports, Big Tech and the arts.Additional Reads
