Sexual offence cases dismissed after complainants withdraw

Three sexual offence cases before the No. 5 Supreme Court have been dismissed after complainants indicated they no longer wished to proceed. One complainant told the court that she wanted her case against Ahmal Gregory Elias, of Vetnor Land, Rockley, Christ Church, discontinued. He was accused of having sexual intercourse with a 12-year-old girl, and unlawfully removing the girl from Hart’s Gap without her consent on November 18, 2016. “I do not want to go through with it,” the complainant, who is now 22, said. Justice Pamela Beckles dismissed the case for want of prosecution. Another complainant indicated she wanted her matter discontinued against Andre Omar Obrien Hinds. “I do not want to go any further with the case anymore,” she said, admitting that she could not recall her age at the time. Hinds, of Lower Carlton, St James, was accused of having sexual intercourse with a woman on July 20, 2016, without her consent, knowing she did not consent or was reckless as to whether she consented. That charge was also dismissed. You Might Be Interested In A third complainant told the court: “I no longer want to proceed” with the case against Nicholai Kamali Patrick Bailey, of Hothersal Turning, Belle Estate, St Michael. He was charged with having sexual intercourse with a woman without her consent, knowing she did not consent or was reckless as to whether she consented on October 1, 2022. Justice Beckles said: “In the circumstances, you are the complainant, and if you are not going through with it, we cannot proceed with it. That is the end of the matter, so the case is dismissed for want of prosecution.” All of the complainants declared that they had not been forced, threatened or coerced into making the decision and had done so of their own free will. After dismissing the charges, Justice Beckles informed the men that they were free to go. (JB)
