Roblox Tries To Dismiss Wrongful Death Lawsuit By Arguing That A Player Gave Up Her Right To Sue When She Was 8 Years Old Published Aug 20, 2026, 1:59 PM EDT Sign in to your TheGamer account In one of its many lawsuits, Roblox has argued that the case should be dismissed because the player at the centre of it signed away her right to sue when she was eight years old. As reported by The Courier Journal, the wrongful death suit centres around Audree Heine, who died by suicide at age 13. Her mother is suing Roblox for being a "harmful and violent influence" on Heine, arguing that she was able to join a community that glorified school shooters despite parental controls. In response, Roblox argues that the lawsuit should be dismissed and go to arbitration, because this is stated in the terms and conditions that Heine agreed to when she was eight. Roblox Under Fire For Trying To Force Arbitration In Wrongful Death Lawsuit In a motion arguing its case, lawyers for Roblox say: "Roblox made the Terms plain and Audree repeatedly manifested her assent, as courts have routinely held in examining similar agreements and as the one at issue here." Their argument, essentially, is that an eight-year-old ticked a box that agreed to the terms and conditions, which stated she would have to go through a "secret arbitration process" in any claims brought against Roblox. "She was a child, she didn't understand arbitration," Heine's mother, Jaimee Seitz, says. "She didn't understand contracts. She didn't understand what the little box could mean years later. But now they want a court to treat that click as though an 8-year-old knowingly negotiated away her right to have these issues heard. It's insulting." Seitz says she set up parental controls in Roblox, and believed this would be enough. However, she says this wasn't enough to stop other Roblox users from "exploit[ing] Audree's emotional vulnerabilities with violent rhetoric, manipulation and social pressure." She was also allegedly able to join a community centred around the Columbine school shooters. This is just one of the more than 100 lawsuits Roblox is facing, as it continues to come under fire over child safety. Roblox argues it is always improving parental controls, and that its measures are "stricter than those found on many other platforms." Specifically, it often points to how in-game chat is limited by age, trying to prevent adults from speaking with children. However, Roblox's existence revolves around user-generated content - seemingly more than it is able to moderate. It also wants to be open for all age groups, which is why it allows under 9s to sign up in the first place, alongside adults. It's this insistence on being everything for everyone and letting users do what they like that makes moderation such an uphill battle.
