‘Reckless disregard for the truth’ in wrongful arrest

NEW ORLEANS — A Louisiana federal court partially dismissed a Hispanic motorist’s complaint arguing he was unlawfully arrested and detained in an ICE facility for four months on charges that he hit a parked Corvette and ran. A sheriff’s deputy arrested him, but a one-hour videotape of the Home Depot parking lot where the collision occurred showed “the damage to the Corvette occurred at some point before plaintiff arrived, meaning he could not have damaged” the car.
