Kahn points to one email that purportedly claimed “Early access savings ENDS TOMORROW — Up to $750 and more!” An email that was sent two days later that “expressly described the promotion as extended,” the court documents state. “False urgency is material to consumers,” the documents reads. “A subject line telling recipients that savings end tomorrow communicates that recipients will lose the advertised opportunity unless they act before the stated deadline and is capable of influencing whether and when recipients open email, visit Defendant’s website, or make a purchasing decision.”Kahn has thus accused Royal Caribbean of violating Maryland’s Commercial Electronic Mail statute, “which prohibits the transmission of commercial electronic mail to an email address the sender knows or should know is held by a Maryland resident when the subject line contains false or misleading information.” Kahn is looking for a jury trial as well as declaratory and injunctive relief. He would also like an award of statutory damages for himself as well as all qualifying class members.
