Police drop year-long case against three Tube passengers who tackled naked man after he dropped his trousers in front of children in packed carriage

See more Daily Mail on Google - save us as a Preferred Source Published: 10:10 EDT, 8 September 2026 | Updated: 10:40 EDT, 8 September 2026 A year-long police investigation into three 'hero' commuters accused of assaulting a man who exposed himself in a London Underground carriage packed with children has been dropped after prosecutors refused to authorise charges.The men were questioned by detectives from British Transport Police (BTP) after coming forward to give their account of the incident on the District Line in August 2025.They were filmed confronting and brawling with the half-naked suspect, who told them to 'f*** off', tried to strike them with his belt and ignored repeated demands to pull up his trousers.The man who exposed himself was initially arrested by an off-duty police officer after refusing to cover up. He was taken to hospital and later sectioned under the Mental Health Act.The focus of the investigation shifted to those who challenged him, with BTP repeatedly describing the man as the victim of an 'assault by a number of other passengers'.The force interviewed the three men under caution and were looking to charge them.However, the Crown Prosecution Service declined to authorise charges, leaving the commuters facing no further action 13 months after the incident.A CPS spokesman said: 'After careful consideration of the available evidence in this case, we concluded there was no realistic prospect of conviction. No further action will be taken.' Passengers repeatedly asked the man to put his genitals away before a fight broke out. British Transport Police said in a statement that the naked man was assaulted but have dropped the case after a yearA group including an off duty policeman carried him off the train and pinned him down on the platform, waiting for help to arrive. The naked man was sectionedFormer policeman Harry Miller has said it was 'very disturbing' that BTP had pursued the case for so long and praised the Crown Prosecution Service for stepping in.He told The Telegraph: 'In any normal world there was no possibility of a prosecution. Those three people were doing what any normal person would do in the absence of a police officer on a train. 'Yet again, the police have failed to understand what their duty is, which is to protect and serve, not to go around persecuting those who take the safety and dignity of other passengers into their own hands because the police are not present'.BTP defended their investigation today.A spokesman said: 'In August 2025 we launched an investigation into an incident on board a District Line train at East Ham, which was well circulated on social media. 'We interviewed three men in connection to the incident and presented a file of evidence to the Crown Prosecution Service (CPS) who have not authorised charges. 'The other man concerned – who was suffering significant mental health crisis at the time of the incident – remains in hospital receiving appropriate care.'Assistant Chief Constable Charlie Doyle added: 'It is irresponsible to suggest that anybody has a "duty" to behave like this, particularly towards an extremely vulnerable person suffering significant mental health crisis. 'While charges to CPS weren't successful in this case, it is right that a criminal investigation took place and we will not hesitate to pursue prosecution for those who choose to act in such a way in future.'The Daily Mail revealed last year how the naked man began yelling after the eastbound train travelled between Upton Park and East Ham.He then dropped his trousers and put his belt around his neck. His bottom and genitals were on show, sparking anger and revulsion around him on the train, which was busy with children on their summer holidays.A passenger stood up and quickly confronted him, gesticulating angrily. He politely and firmly told him: 'You need to get off the train.' But the man began repeatedly yelling back: 'F*** off.'The commuter said in response: 'What do you mean 'f*** off'? You need to get off the f***ing train. Now. There are kids on here.'The men were branded 'heroes' by supporters of their actions when footage went viral on social media. Video of the incident showed up to four men kicking and punching the naked man, who was hitting them with his belt. The video then cut to him being pinned to the floor of the carriage. The man was then unceremoniously carried on to the Tube platform at East Ham and dumped to the floor. He was then pinned down as the commuters tried to alert staff.Just a month earlier a brawl broke out on the steps of a packed station - with a screaming toddler ending up on the floor in the chaos.
