The woman, Nohemi Castillo, said she ordered takeout from Austin’s South Congress Avenue location on June 9 and nearly swallowed the tooth, which was allegedly embedded in the “Democrat” taco. The Democrat taco contains beef barbacoa as the meat, along with avocado, cotija cheese, cilantro, diced onions and a lime wedge with tomatillo salsa, piled on a corn tortilla – no cow’s tooth included. KVUE obtained the lawsuit, which stated that Castillo was “grossed out and sickened” by the discovery and even went to the doctor and was “given some prescriptions”: The suit claims that the manager of the South Congress Torchy’s was notified of the situation and claims it was “unclear what if anything he did to remedy the problem within his food and under his control.” As a result, Castillo is suing the chain for $250,000, “alleging that Torchy’s was negligent by selling a product that was not up to standards,” per the outlet. “I thought they’d want to take care of this internally immediately, but apparently not” attorney Scott Vasquez, representing Castillo, said. “They felt, in my view, ‘Let’s blame someone else.’” He asserted that at some point down the line someone should have noticed the tooth, noting that it poses a major choking hazard. “It’s large,” Vasquez said. “It could choke someone, it really could.” A witness also confirmed what happened as Castillo nearly ate the tooth. “As we were eating, I heard an ‘awww!’ When I turned to Nohemi, I saw her pulling something out of her mouth, she said, ‘I think it’s a bone.'” According to Fox News Digital, Vasquez claims that “he has become aware of other individuals reporting similar experiences with Torchy’s since the story received attention, although those accounts have not been independently verified.” Indeed, Torchy’s confirmed after analysis that the item found in the Democrat taco was, in fact, a cow’s tooth. The company said it “can occasionally happen when processing the meat, though it is quite rare.” “We are aware of the situation and take all concerns about our food seriously,” Torchy’s said in a statement. “We source the highest quality food available, which means our barbacoa comes from natural beef cheek that we source from a supplier.” “Food safety is a top priority, and we maintain robust food handling, preparation and quality control procedures. Upon receiving the guest complaint, we conducted a thorough review and identified the item as a cow tooth,” it confirmed. “This can occasionally happen when processing the meat, though it is quite rare. We have partnered with our supplier to reinforce their internal procedures to prevent this from happening in the future.”
