News and notes from around the interweb: Passenger says he and Atlanta TSA missed the loaded magazines in his bag, now he faces a mandatory minimum 15 years in a Jamaican prison “The father of three forgot to remove two loaded ammunition magazines from his carry-on backpack before a family vacation to Jamaica.” He “admits he made a serious mistake.” Jamaican airport security found the magazines (no gun) at the airport as they prepared to fly home. While what happened to the man wasn’t TSA’s fault, it was his fault – of course TSA missed it, and it’s true if they’d done their job the way they were supposed to the penalties on the father would be far less. The guy is out on bail and home in Georgia. I guess if they won’t plea to a lesser charge he just doesn’t ever return to Jamaica…? Although Jamaica could request extradition. Circulating a warrant through Interpol could ame any foreign travel risky. He could be tried in absentia and face ana dditional 5-7 years consecutive with his sentence for the failure to appear. But I thnk he’d have a good argument against extradition? He doesn’t appear to have committed a serious U.S. crime (his possession of ammunition is legal in Georgia, he would have violated rules bringing it to a TSA checkpoint but it wasn’t knowing, willful or reckless. With the caveat that this is not my area at all (and I’d love to hear from those whose it is in the comments), jumping bail satisfies the dual criminality requirement for extradition if the U.S. chooses to do so.
