As Republicans grapple with forecasted losses come Election Day, some MAGA officials have concocted a plot to potentially keep some Democrats from taking office. According to Fox News, a little-known loophole could prevent members of the Democratic Socialists of America from being sworn in to the House of Representatives — even if they win on Tuesday — and potentially keep Democrats from reaching a House majority. When members-elect officially join Congress, they swear an oath to uphold the Constitution before becoming full members of the House. However, an argument growing in MAGA circles is that any member-elect can challenge another member’s right to be sworn in, as long as they provide evidence that the person would not uphold their oath. This means that instead of the oath taken en masse by all 435 members, there would be House-wide deliberations followed by a vote to determine whether that member-elect should be sworn in. Those weighing this loophole say that an argument can be made against DSA members because the group calls for the drafting of a new constitution. Texas Rep. Keith Self, a Republican, suggested to Fox News that he could invoke the maneuver. “You cannot swear an oath to support and defend the Constitution while actively working to destroy it. The oath of office is not just words you say at a ceremony. It is a belief. It is an oath to our country and our fellow countrymen,” Self said. "The House has both the authority and the duty to ensure that anyone who takes that oath does so in good faith, without mental reservation or purpose of evasion. As DSA candidates and the Red-Green Alliancegain ground, we must enforce the Constitution as written or risk allowing people committed to replacing it to take seats of power under false pretenses,” Self added. The “Red-Green Alliance” is a term used by conservatives to describe collaboration between far-left movements (red) and Islamist or political Islam organizations (green). (Republicans are expected to lose majority in the House of Representatives this Election Day)Self, who has been representing Texas’ third congressional district since 2023, added: "Anyone who has personally embraced the destruction of the Constitution has no business being sworn in to uphold it.”However, the theory relies on several things to work. If House Minority Leader Hakeem Jeffries, a Democrat from New York, is elected speaker, he could decide to dismiss the challenge altogether, according to the report. Speaker Mike Johnson, a Republican, could also dismiss the challenge if Republicans keep the majority. Johnson indicated he could do so when speaking to reporters at an event in Iowa earlier this month, saying that refusing to seat elected Democrats was a “nonsense narrative” and vowed, “We are going to follow the law.” Democrats only need three seats to flip the majority — and recent polling has shown they’ll likely be able to do so by flipping between 12 and 25 seats, giving them a majority in the House.
