Clancy's defense team and the prosecution will go before Judge William Sullivan, with the state now making it pretty clear it wants another trial. Prosecutors are fighting Clancy's request to be found not guilty for lack of criminal responsibility, arguing there was enough evidence for a jury to find her criminally responsible for killing her three children. The prosecution is also asking the judge to restrict what attorneys can say publicly about the case, arguing the massive media attention and comments from Clancy's defense could taint a future jury pool. Clancy's defense, meanwhile, wants Sullivan to find her not guilty ... arguing the state failed to prove she was criminally responsible when she killed her three children. If the motion is granted and holds up, the ruling would essentially block another trial. Clancy's attorneys are also seeking to have the charges dismissed on double jeopardy grounds and want the court to investigate the lone holdout juror, including his alleged phone use during deliberations. As TMZ reported, jurors deliberated for 38 hours before deadlocking 11 to 1. Eleven jurors were prepared to find Clancy not guilty by reason of lack of criminal responsibility. Clancy's defense argued she was suffering from postpartum psychosis when she strangled 5-year-old Cora, 3-year-old Dawson, and 8-month-old Callan in January 2023 ... while prosecutors argued the killings were planned.
