Kim Zolciak Speaks Out After 15-Year-Old Son’s Aggravated Sexual Battery ArrestContent warning: This story discusses allegations of sexual assault. Kroy "KJ" Biermann Jr.'s case is moving forward. The 15-year-old son of Kim Zolciak and Kroy Biermann was indicted Sept. 3 on seven counts following his Aug. 17 arrest, including aggravated child molestation, aggravated sexual battery, aggravated sodomy, sexual battery against a child under 16 and false imprisonment, according to court documents obtained by E! News. A grand jury from Fulton County, Ga., validated the charges, which allege that KJ "did unlawfully commit an immoral and indecent act" with a "child under the age of 16 years" on April 23, among other acts related to sexual assault. The charge for false imprisonment accuses KJ of "unlawfully" detaining the victim "without legal authority and violation of the personal liberty" of the minor. The alleged incident took place in a Lifetime Fitness gym's changing room, per a criminal warrant obtained by E! News. After KJ was charged, his attorney Jason Sheffield spoke out on his behalf to maintain his innocence. "I respect the difficult responsibilities carried by prosecutors and victim advocates," Sheffield wrote in a statement to E! News. "Cases involving children require patience, care, and a commitment from all of us to understanding the full picture as the process continues." "There are two children at the center of this case. KJ was 14 years old when these events allegedly occurred. He was arrested at 15 and, less than three weeks later, indicted on charges carrying extraordinary consequences," he continued. "But adult consequences do not transform a child into an adult. The choices and conduct of children should not suddenly be viewed through an adult lens simply because the consequences are severe." Prince Williams/WireimageThe lawyer said the arrest and indictment "cannot tell us the whole truth of a case" because the magistrate judge and the grand jury "have heard only one side,” saying the accused person "has no right to participate, present evidence, cross-examine witnesses, or have a voice in the proceeding. That is not a criticism of the process; it is simply where we are." As such, Sheffield emphasized that he believes evidence he has gathered will clear the allegations against KJ. "Without DNA evidence, the case remains one of 'she said, he said' and the credibility of the accuser. The evidence that I have gathered will prove, at the appropriate time and place, that KJ Biermann is not guilty of these horrific allegations," he explained. "God willing, that place will be juvenile court, where the lives of these young people can be respected and honored." "Until then, these are children whose lives should not become something for adults to 'thumbs up' or 'heart' on social media," Sheffield said. "We should not cheer against children." After KJ was taken into custody in Alpharetta, Ga., on Aug. 17, Kim spoke out in defense of her son, stating that he had passed a voluntary polygraph test and that DNA evidence was not found during an investigation of the alleged event.
