2 min readAnother day, another fake scandal, another fed-up federal judge who is reconsidering his career choice. From The Hill:A federal judge on Monday dismissed charges against two former FBI officials who were accused of lying to Congress about their involvement in the federal investigation into Hunter Biden’s laptop.Judge Zia Faruqui, a magistrate judge who sits on the federal bench in D.C., found no probable cause to support charges against Nikki Floris and Bradley Benavides, who were accused of making false statements during interviews with the House Judiciary in 2023.Like so many of his peers, thank the Lord, Judge Faruqui can see a church by daylight.“There is no denying this investigation was rushed,” Faruqui said during a roughly hourlong hearing, later adding that it “cannot be described as anything other than weaponization” of the Justice Department (DOJ). Faruqui oversaw several days of proceedings in which defense attorneys elicited testimony from an FBI special agent revealing that FBI Director Kash Patel directed the investigation into Floris and others the day after President Trump delivered a speech in the Oval Office in July rehashing claims of fraud and foreign interference in the 2020 election.A politically motivated criminal investigation that turns out to be utterly worthless? What are the odds? The agent, Bryan Witt, testified during those proceedings that he was concerned the case was a distraction and could be “viewed as political.” The judge found that “extremely troubling,” he said, noting the government’s longstanding practice of avoiding major investigative actions so close to an election.“I will not bury my head in the sand,” Faruqui said of the timing. The criminal complaint against Floris and Benavides was filed on October 20, two weeks before the midterms. “I will not lobotomize myself in that way,” he added.I'm sorry, Judge Faruqui, you have no future in Republican politics.Elsewhere in the wild kingdom, on another front on which he is consistently hammered, the president has decided to go to his bullpen. From The New York Times:The Trump administration asked the Supreme Court on Monday to require that California set aside 20,000 mail-in ballots that the administration claims have been provided to noncitizens. The emergency application to the justices came after a divided federal appeals court rejected the administration’s arguments that California officials should impound the ballots for further scrutiny. Legal experts have been skeptical of the Trump administration’s arguments in the case. Filing just one day before the midterm elections may forestall a ruling in the case—and a potential loss for the administration—until after Election Day.And the Court, with its carefully manufactured conservative majority, finds itself teetering between obsequious loyalty and judicial integrity. My guess is that the Court won't ever act on this. It will let the appeals court decision stand, and everybody will stay away from Justice Alito for a week or 10 days, depending on how long it takes to put out the fire in his hair.
