Intersex prison rape claims dismissed

PHILADELPHIA — A federal court in Pennsylvania dismissed an intersex detainee’s negligent supervision and retention claims against the federal government arising from her alleged rape after prison officials placed her with a male cellmate. The detainee, who speaks only Spanish, claims she told officers she was female but was not moved to the female cellblock until 13 days later. Federal prison regulations give officials discretion over how employees are supervised and disciplined, so the U.S. cannot be sued on those claims under the Federal Tort Claims Act.Read the ruling here.Subscribe to our free newslettersOur weekly newsletter Closing Arguments offers the latest about ongoing trials, major litigation and rulings in courthouses around the U.S. and the world, while the monthly Under the Lights dishes the legal dirt from Hollywood, sports, Big Tech and the arts.Additional Reads
