Halle Berry has been accused of physically abusing her 12-year-old son Maceo by ex-husband Olivier Martinez. People has reported that yesterday (Thursday October 1), a Los Angeles County judge granted Martinez’s request for a temporary restraining order that covered both himself and Maceo. The filing claims that Berry caused Martinez “emotional and mental distress due to physical abuse” of Maceo during an incident where Berry allegedly “grabbed Maceo by the neck” while shouting “Who is dominant”. Martinez also claimed that Berry had previously engaged in instances of “verbal and emotional abuse” against him as well as “additional physical attacks” against their son. Berry has denied the claims. “To say this filing is entirely meritless and deliberately misleading would be an understatement,” Berry’s lawyer Mariana Beck said in a statement to People. “Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.” Court reports show that the judge modified Berry’s visitation rights but the couple will still share partial custody. The judge denied Martinez’s request that Berry’s sobriety be monitored due to “insufficient information.” The temporary restraining order will be in effect until a hearing on October 16 where a judge will determine whether or not to make the order permanent. Martinez’s lawyer Patrick Baghdaserians said his client’s main concern is “the health, welfare and the safety of [Maceo]” which is why he requested a domestic violence restraining order. “His second concern would be for [Halle Berry] to get the appropriate help that she needs to address her issues so she can better herself, which would in turn help the minor child moving forward,” Baghdaserians added.
