With the Trump administration tightening immigration rules and US Vice President JD Vance accusing technology companies of misusing the H-1B visa system, Indian professionals are looking at other ways to work in America.The L-1 and O-1 visas are two possible options, but both have strict eligibility requirements and are not suitable for everyone.The debate gained attention after the Trump administration suspended Microsoft and several other technology companies from the Permanent Labour Certification (PERM) programme, which is part of the employment-based green card process. Vance accused Microsoft of abusing the H-1B system and described foreign workers hired through outsourcing firms as "indentured servants".The suspension does not mean the H-1B programme itself has been stopped. However, the development has raised questions about other US work visas and whether they could offer Indian professionals another way to work in the country. L-1 OR O-1: WHICH ROUTE FITS WHOM?The L-1 visa allows eligible multinational companies to transfer employees from an overseas office to a related office in the US. It has two categories: L-1A for executives and managers, and L-1B for employees with specialised knowledge.The O-1 visa, meanwhile, is meant for individuals who can demonstrate extraordinary ability or achievement in fields such as science, education, business and the arts. Unlike the L-1, it is not based on transferring an employee between offices of the same organisation. So, while both visas can allow eligible professionals to work in the US, they have different eligibility requirements. An employee working for an eligible multinational may explore an L-1 transfer, while someone with an exceptional record of achievement may consider the O-1 route.CAN EITHER VISA BE A SIMPLE H-1B REPLACEMENT?An L-1 or O-1 visa may offer another route for eligible Indian professionals, but neither is a guaranteed workaround for H-1B restrictions.Suneet Singh Kochar, CEO and Founder of Fateh Education, says the L-1 and O-1 visas are genuine options, but only for professionals who meet specific requirements."They are genuine routes into US, but it's not for everybody. It's for a very narrow group of people," Kochar says.The L-1 visa may suit professionals working for multinational companies that can transfer them to a qualifying US office. The O-1 visa, meanwhile, is meant for individuals who can demonstrate extraordinary ability and professional achievements.Kochar says the eligibility bar for the O-1 is particularly high. "While some would qualify, most likely wouldn't," he says.Saurabh Arora, Founder and CEO of University Living, advises professionals to assess their eligibility before choosing a route. Those considering an L-1 should check internal transfer opportunities, while potential O-1 applicants should evaluate their professional recognition, significant contributions and leadership roles.LOOK BEYOND THE VISASecuring a visa should not be the only consideration when planning a move to the US, Arora says. Professionals must also weigh the role, compensation, cost of living, family needs and longer-term immigration prospects.His advice is to treat immigration planning as part of career planning, understand the eligibility requirements early and seek guidance from a qualified US immigration professional.Aditya Shanker Raghuwanshi, Founder and CEO of Masterclass Space, also cautions against treating alternative visas as shortcuts. "There's no shortcut here. The students who do well are the ones who plan early," he says.In other words, neither visa offers a straightforward workaround for someone who cannot secure an H-1B. Eligibility depends on an applicant's employment history, professional achievements and the requirements of the particular visa category.For Indian professionals, the choice therefore depends on their circumstances: an eligible employee may explore an L-1 transfer, while a professional with an exceptional record may assess the O-1.- Ends
