Delhi tribunal awards Rs 76.72 lakh to man left 75% disabled in truck crash

A Delhi tribunal has awarded Rs 76.72 lakh to a 24-year-old man left severely disabled in a truck crash. The order recognises his lifelong need for nursing care, attendant support and loss of earning capacity.The tribunal said the man would need continuous nursing care and medical attention, and that his life expectancy had been shortened because of the grievous injuries. (Representative image)A Delhi Motor Accident Claims Tribunal has awarded Rs 76.72 lakh to a 24-year-old man who suffered 75 per cent permanent physical disability in his upper limbs and brain in a road accident, holding that he is unable to carry out daily activities or earn his livelihood.The tribunal also said he would need continuous nursing care and medical attention, and that his life expectancy had been shortened because of the grievous injuries.In its September 7 order, Presiding Officer Deepika Singh directed New India Assurance Company Ltd, the insurer of the truck involved in the accident, to deposit the compensation with 7.5 per cent annual interest from August 8, 2022, the date of filing of the claim, until realisation.The insurer has been given 30 days to make the deposit, failing which the interest rate will rise to nine per cent for the period of delay. The tribunal was hearing a claim petition filed by Dinesh Kumar, who was injured on April 22, 2021, when a truck driven by Mohammad Israil hit his scooty from behind near Badli metro station. Kumar and his wife were travelling on the scooty at the time.The order said, "It stands duly proved that the accident had taken place due to rash and negligent driving of the offending vehicle by R1 (truck driver) and hit the petitioner's scooty and thereby caused injuries to the petitioner and her husband." Relying on medical evidence, the tribunal noted that Kumar had suffered 75 per cent permanent physical disability in both upper limbs and the brain. A doctor told the tribunal that he had difficulties with learning, attention, memory and communication, and could not focus on work or travel alone to distant places.While calculating the compensation, the tribunal took Kumar's monthly income at Rs 19,717 and his age at about 24 years at the time of the accident, awarding Rs 31.91 lakh towards loss of earning capacity. It also awarded Rs 34.36 lakh towards attendant charges during treatment and in future, saying that his condition would require an attendant for life.In all, the tribunal awarded Rs 76.72 lakh under various heads, noting that Kumar has been in a bed-ridden-like condition since the accident.- EndsPublished By: India Today Web Desk Published On: Sep 15, 2026 12:31 IST
