When she was arrested, she told police she had been keeping her son “safe” from his dad and parental relatives. Daly made unsubstantiated claims that Basil “would have been in danger and molested” with his father. She claimed the child’s dad “never wanted anything to do with Basil, financially, physically, emotionally ever”. Daly had taken Basil from Wyoming against a court order that had given the child’s dad emergency custody. Dad Jake Stoner reported the child missing on November 28, telling investigators he had last seen his son two months earlier. Daly had disappeared, but when her warrant was flagged on a background check for a job she applied for, a business owner called the cops. Police tracked her down to a bunkhouse and she ran into a nearby RV. Cops were waiting for a warrant to search the vehicle when they heard a single gunshot. They rushed in to find Basil had been shot dead. Paramedics tried to save the child, but nothing could be done. Daly told police she had kidnapped her son because “she was not going to allow her son to go back and forth from Nebraska to Wyoming twice a month”. Detective Lt. Jason Jordan wrote in an affidavit: “Even if the rest of life is worthless she would do it again just so to make sure that the (family) didn’t touch him.” It said: “When asked what went through her mind when she saw law enforcement walking up, she replied, ‘Jake can’t get Basil.” The child’s dad was devastated, with his lawyer saying he had sat by the phone for hours waiting for news of Basil. Madeline pleaded guilty to first-degree murder and is facing life in prison.
