SUMMER weather often means more BBQs, but heavy smoke can cause some tension between neighbours leaving many unsure of their rights. There is no outright law in the UK banning BBQs in gardens or private outdoor spaces, even when it is annoying. With that said, excessive smoke, fumes or repeated disturbances could amount to what councils call “statutory nuisance” in some circumstances. Islington Council has previously warned that nuisances could result in court appearances and a hefty fine if convicted. Councils will typically issue warnings first and will consider factors such as frequency, duration and severity if a complaint has been lodged by a neighbour. Under GOV.UK guidance, local authorities can investigate complaints involving smoke, fumes and smells that unreasonably interfere with somebody’s use or enjoyment of their property. While individuals are encouraged to try and resolve the problem with the neighbour civilly, if issues persist, there are steps they can take that can help bolster their complaint.
