Allahabad HC cancels rape accused's bail after he refuses marriage

The Allahabad High Court cancelled a rape accused's bail and reprimanded Meerut police officials. The order underscores accountability for breached bail assurances and ignored production warrants.Prayagraj,Oct 24, 2026 22:00 ISTThe Allahabad High Court directed the Meerut Senior Superintendent of Police to stand in court for the entire hearing after he failed to produce an accused as ordered, news agency Press Trust of India reported. The court also cancelled the accused's bail after he refused to marry the survivor in a rape case, despite having earlier secured bail on the condition that he would do so.Justice Arun Kumar Singh Deshwal passed the order while hearing a bail cancellation application filed by the survivor. The court also instructed the police officer to exercise greater care in future.During the proceedings, the SSP told the court that the accused could not be produced earlier because the Chief Judicial Magistrate in Meerut had sent him to judicial custody after a subordinate officer produced him before the magistrate in accordance with the warrant, PTI reported. The judge, however, said the SSP was responsible for executing the non-bailable warrant and was duty-bound to ensure that the accused was produced before the High Court. The court also directed the administrative judge in Meerut to take action against the Chief Judicial Magistrate. "It is also surprising that the CJM, Meerut, despite knowledge of the order of this court and knowing the fact that a non-bailable warrant has been issued by the High Court for producing opposite party no. 2 before this court, sent him to judicial custody without any direction to produce him before this court. This fact shows sheer negligence and indiscipline on the part of CJM, Meerut," the court said. The survivor had sought cancellation of the accused's bail on the ground that he had failed to fulfil his commitment to marry her. The court subsequently issued a non-bailable warrant for his production. When the accused appeared before the court on Saturday, he refused to marry the survivor. The court then cancelled the bail granted to him on the basis of his earlier commitment and held the SSP accountable for failing to produce him as directed.- Ends
