Adidas loses argument over undisclosed emails

MANHATTAN — The Second Circuit affirmed a New York federal court’s decision to reject Adidas’ latest stab at its trademark infringement and unfair competition claims against Thom Browne over its striped activewear. Adidas alleges that Thom Browne failed to disclose several emails in discovery, but the district court correctly reasoned that the emails would not have changed the verdict, and the failure to disclose did not amount to “misconduct.”
