MANHATTAN — The Second Circuit declined to enforce a National Labor Relations Board order on Starbucks’ dress code governing issue pin and logo shirt policies, finding it was founded on a misreading of precedent. The appellate court asks the NLRB to apply “a more evenly measured balancing test” of company and union interests to analyze whether the coffee retail giant’s policies violate the National Labor Relations Act.
